This is the last Will and Testament of me Henry Robert Coulter of Little Sharsted in the parish of Doddington in the County of Kent Gentleman. I direct that all my just debts and funeral and testamentary Expenses and Legacies be paid by my Executor out of my personal estate and I appoint my nephew Thomas Read the son of my sister Ann Read Widow the Executor of this my Will and I give and bequeath the sum of five hundred pounds apiece of lawful money current in Great Britain unto Henry Cooper and William Cooper the 2 sons of my niece Harriet the Wife of Richard Cooper both deceased but if either of them shall die under the age of twenty one years and without lawful sons living at his decease then and in such ..... and bequeath the legacy so ..... to the survivor of them who shall live to attain that age for his absolute use and benefit but such legacies under no circumstances to be paid to till the expiration of six calendar months after my decease Also I give and bequeath the sum of five hundred pounds apiece of like money to my nephews and nieces William Henry Divers Selina Smithers the wife of Thomas Smithers and Jane Divers Spinster (three of the children of my sister Susanna the Wife of John Divers both deceased) and the sum of One Thousand pounds to my Niece Emily Bing (the Wife of Thomas Bing and another of the children of my said sister Susanna Divers) the same legacies to be paid respectively at the expiration of six calendar months next after my decease And I give and bequeath the sum of Six thousand pounds of like money to the said Thomas Read his executors administrators and assigns upon trust that the said Thomas Read his executors or administrators so and shall within the space of six calendar months next after my decease lay out and invest the same in his or their name or names in or upon the public stocks or funds or on government or .... securities in England and ..... them ..... and so possessed of and invested in the said sum of six thousand pounds and the stocks funds and securities wherein the same shall be invested with power from time to time at his or their discretion to alter vary and transpose the said stocks funds and securities Upon trust to pay the dividends interest and annual proceeds thereof as and when the same shall become one unto my niece Amy Morris Davis the Wife of Solomon Davis and another of the children of my said sister Susanna Divers or permit her to receive the same during her life And from and immediately after her decease as to the said sum of six hundred pounds and the stocks funds and securities wherein the same shall be invested .... the dividends interest and annual proceeds thereof on trust for all and every the children of my said niece Amy Morris Davis equally to be divided between or among them share and share alike to be vested interests all and transferred or paid to such children respectively at the times and in the manner following that is to say the part or share parts or shares of such of them being a son or sons to be transferred or paid to him or them at his or their age or respective ages of twenty one years and the part or share or parts or shares of such of them being a daughter or daughters to be transferred or paid to her or them at her or their age or respective ages of twenty one years or day or respective days of marriage which shall first happen unless such respective times shall happen in the lifetime of the said Amy Morris Davis and in such case the part or share parts or such of them as being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or be married in the lifetime of the said Amy Morris Davis shall be transferred or paid immediately or with all ... ....... speed after her decease Nevertheless the same shall be ........ vested interests in such son or sons at his or their age or respective ages of twenty one years and in such daughter or daughters at her or their age or respective ages of twenty one years or day or respective days of marriage which shall first happen and if any one or more of the present or future children of my said niece Amy Morris Davis being a son or sons shall depart this life under the age of twenty one years or being a daughter or daughters shall depart this life under that age not having been married Then as well the original as any arriving share or shares of such child or children so dying shall go and .... and be disposed of to or for the benefit of the survivor or survivors of the same children in the manner to all intents and purposes as if such child or children so dying had never existed And .... this further trust that the said Thomas Read his executors or administrators do and shall after the decease of the said Amy Morris Davis pay apply and dispose of the dividends interest and annual proceeds of the said sum of six thousand pounds and the stocks funds and securities wherein the same shall be invested in for and towards the maintenance and education of the children of the said Amy Morris Davis until their respective shares of the capitals principal shall become transferable or payable to them and in proportion to their respective shares and interests therein And I give and bequeath the sum of five thousand pounds of like money unto my niece Catherine Brire (the Wife of William Brire and Daughter of my said Sister Ann Read) to be paid to her within six calendar months next after my decease And I give and devise all that my messuage or tenement called Stapleton with the barn stable outhouses ....... and b........ yard garden orchard and several pieces or parcels of land arable meadow and pasture and shaws to the same belonging containing together by estimation thirty four acres and thirty one perches more or less with the appurtenances situate lying and being in the parish of Witchling in the said County and now in the several occupation of Kite and Eagles and purchased by me in or about the year One thousand eight hundred and thirty three of Thomas Clements and others Unto my said Niece Catherine Brire and her assigns during her life ..... they keeping the buildings and fences thereto belonging in good repair ..... and condition and the buildings insured against fire and paying all land tax and quit rents (if any in respect of the said premises) And from and immediately after her decease I give and devise the said messuage or tenements buildings land hereditaments and premises with their appurtenances unto and to the use of all and every the present and future children as well as sons and daughters of my said niece Catherine Brire equally to be divided between or among them share and share alike as tenants in common and not as joint tenants and their several and respective heirs and assigns for ever and in case any one or more of the present or future children of my said Niece Catherine Brire being a son or sons shall depart this life before he or they shall attain his or their age or respective ages of twenty one years and also without lawful issue living at the time of his or their decease or born in ... ..... thereafter or being a daughter or daughters shall die before she or they shall attain her or their age or respective ages of twenty one years and without having been married Then and in such case I give and devise the part or share or parts and shares as well ........ as ......... of him or her or them so dying unto the survivor or survivors of them (if more than one) equally to be divided between or among them share and share alike as tenants in common and not as joint tenants and to their several and respective heirs and assigns for ever And I give and devise all and every other the freehold messuages or tenements farms lands and hereditaments and real estate whatsoever and whereso ever situate lying and being not hereintofore disposed of wherefor ....... I am or any person or persons in trust for me is or are seized or interested or over which I have a disposing power with their and every of their rights members and appurtenances unto and to the use of my nephew the said Thomas Read his heirs and assigns for ever And I give and bequeath an annuity of fifty pounds of lawful money current in Great Britain to my said sister Ann Read and her assigns during her life and a like annuity of fifty pounds to my sister Martha Payne Widow and her assigns during her life and I direct that the said several annuities shall be paid to the said annuitants by my Executor out of my residuary personal estate by equal portions half yearly in every year without any deduction or abatement whatsoever And that the first half yearly payment shall be made at the expiration of six calendar months next after my decease And that the legacy only payable in respect of the said several annuities and all incidental expenses in respect of the same shall be discharged out of my residuary personal estate And as to all my household goods and furniture and implements of household and husbandry plate linen woollen and china and all my live and dead stock and all my stocks funds monies due on mortgages and other securities ..... goods chattels and effects And Personal Estate whatsoevernot herein before by me otherwise disposed of I give and bequeath the same and every part thereof and all my estate and interest ........ after and subject to the payment of all my just debts and funeral and testamentary expenses and the said several legacies and annuities herein before bequeathed and the legacy duty herein before directed to be paid unto my said nephew Thomas Read his executors and administrators to and for his and their absolute use and benefit and I so hereby devise all hereditaments and real estates except hereditaments held for any term or terms of years vested in me solely upon any trusts or by way of mortgage and subject to redemption Unto and to the use of my said nephew Thomas Read his heirs and assigns subject to such trusts or to such right and equity of redemption as may affect such real estates respectively at the time of my decease but so that the monies but upon any such mortgage or mortgages shall be .......... as part of my residuary personal estate and hereby revoking all previous wills I declare this to be my last Will and Testament In witness thereof I have herein... set my hand and I have also set my hand to .... of the three preceding sheets of this my Will this tenth day of August in the year of our Lord One thousand eight hundred and forty three - Henry Robert Coulter - Signed by the above named Henry Robert Coulter the Testator as and for his Will in the presence of both of us present at the same time who at his request in his presence and in the presence of each other so attest and subscribe the same the words this life under the age of twenty one years or being a daughter or daughters shall depart appearing between the seventeenth and eighteenth lines from the bottom of the second sheet hereof having been .... ........ and the words lawfully begotten and to be begotten appearing in the first and second lines from the top of the same sheet having been first struck through with a pen - Weller Norwood - Edwd. This is a Codicil to be annexed to and taken as part of the last Will and Testament of me Henry Robert Coulter of Little Sharsted in the parish of Doddington in the County of Kent Gentleman bearing date the tenth day of August One thousand eight hundred and forty three Whereas I have by my said Will given and bequeathed to my nephew William Henry Divers a legacy or sum of five hundred pounds Now having already advanced to my said nephew several sums of money as free Gifts I hereby revoke the bequest of the said legacy of five hundred pounds to my said nephew And I give and bequeath the sum of three hundred pounds to such of the children of my said Nephew who shall be living at my decease equally to be divided between or among them share and share alike to be vested interests in and paid to such children respectively at the time and in manner following that is to say the part and share or parts and shares of such of them being a son or sons at his or their age or respective ages of twenty one years and the part and share or parts and shares of such of them being a daughter or daughters at her or their age or respective ages of twenty one years or day or respective days of marriage which shall first happen And if any one or more of such children being a son or sons shall depart this life under the age of twenty one years or being a daughter or daughters shall die under that age having been married Then I give and bequeath the part and share or parts and shares of him or her or them so dying to the survivor or survivors of them if more than one equally And I declare that as well the original as any arriving share or shares shall vest in and be payable to such survivor or survivors at the time or respective times herein before appointed for the vesting and payment of their his or her original shares or share And I direct that the Executor named in my said Will shall after my decease apply the income arising from the respective shares to which such children of my said Nephew shall from time to time be presumptively or actually entitled and in the said legacy or sum of three hundred pounds for and towards their maintenance and education or otherwise for their benefit respectively until such shares become payable and in all other respects I hereby ratify and confirm my said Will and declare this to be a Codicil thereto In Witness whereof I have ...... to set my hand this fourth day of November One thousand eight hundred and forty four - Henry Robert Coulter - Signed by the above named Henry Robert Coulter the Testator as and for a Codicil to his last Will and Testament in the presence of both of us present at the same time who at his request in his presence and in the presence of each other so attest and subscribe the same the words "in all other respects" having been first inserted between the fourth and fifth lines from the bottom of the same - Edwd. Proved at London with a Codicil the 15th January 1849 before the Worshipful John ....ard Doctor of laws and Surrogate by the Oath of Thomas Read the sole Executor to whom Admon was granted having been first sworn only to administer.
